the united states to canada, made the first court appearance. the 35-year-old did not enter a plea during the brief appearance in toronto, and the other suspect will appear before a judge if montreal tomorrow. law enforcement officials say the suspects intended to plant bombs to destroy the tracks, derailing the canadian trains which partners with amtrak to provide service between canada and new york. it is the first plot tied to al qaeda to target canada. >> new this morning, officials in libya are looking for whoever is behind a deadly car bomb that exploded just outside the french embassy in tripoli. the explosion killed two french guards and a libyan teen. libya and france have condemned the attack. >> oakland police want to fine the person who spray painted racist graffiti on a woman's car this morning. the vandal targeted this white bmw on 56th which included two racial slurs.

the car's owner said she was awakened by the sound of someone spray painting her car. >> it is ridiculous we have people in this day and age walking around with this mentality. i grew up in this neighborhood, i have been here for over 40 years and i never seen figure -- anything like this. >> the owner has to find out how much it will cost to have the car repainted. >> oak police are look for a shooting suspect would got away after a stand off. police believe the man was barricaded inside the home near 65th but the s.w.a.t. officers did not find him after 6:00 this morning. the suspect is wanted for a shooting on 90th avenue that happened 10:30 last night. the victim is expected to die. california highway patrol is planning to boost its presence in oakland. the c.h.p. and the city reached a new deal for expand patrols to four day as week up from the two days they currently patrol. the contract was set to expire on friday but the city council

will vote on the new deal at the may 7 meeting. the alameda county sheriff stopped its patrol from oakland last weekend. >> new bill aimed at giving more rights to the homeless in california is out of committee and on the way to the next step. abc7 news reporter amy hollyfield joins us in san francisco. this bill would also create local centers. >> it is a wide, sweeping bill and the city of san francisco has an ordinance in place saying you cannot sleep on this sidewalk or panhandle and the state is closer to saying, yes, you can. when people think about whether homeless people should be allowed to panhandle and sleep on the sidewalk, some say, it is complicated. >> it is allowed. if it is not allowed, where would they go? it is kind of...it is happening now. i don't know. >> a bill in sacramento is

advancing toward becoming law. assemblyman is trying to pass a homeless bill of rights, which would allow. a rescue is about to take place. we will follow this at abc7news.com. >> ground break was held for the first new school in half a century for one peninsula city but as leaders came out to celebrate some in the community are sounding the alarm. abc7 news reporter cornell bernard is on the scene. >> the ground breaking happening a few moments ago at the site of the new and improved hoover elementary school despite efforts by neighbors to stop it. a ground breaking for the newest school in burlingame in 50 years, declining enrollment forced officials to close the school in the 70's but that is all changed now. >> this summer alone we have over 200 students that are coming to the burlingame school district over and above what was predicted three years ago. we need a new school. >> the school straddled the border and some neighbors do not want the school back because of

narrow streets and sidewalks not able to handle more traffic. >> this is a very narrow street and all the streets leading into it or tight and getting kids in and south a big concern. >> one of 20 neighbors have filed suit against the district to stop the re-development of the school. others say that cars go way too fast through the hills. >> they speed as soon as they stop, there is a stop sign, they go fast because -- we have had near misses with our dog. >> this is one of the main routes into hoover school and driving in requires your full attention. there are lots of twists and turns, bridges, as you can see, and a lot of neighbors say this is no place if a kid to be walking. >> i have been traveling the canyon with my kids for the last 15 years and i end up with near misses every day. >> the district says that the

studies have found no safety issues. others say more schools are needed. >> it is good for the neighborhood because the schools and here are overloaded. >> a restraining order filed by neighbors to stop development of the school rejected by a judge last week and another hearing is held next week but if now the new school project is on track. >> four of the top high schools in the united states are in our region. that is according to the rankings by u.s. news and world report with santa cruz getting top high school in california and top five charter schools in the entire country. and american indian public high school in oakland was number 38, nationally. lowell high school if san francisco, number 48. mission san jose high school in fremont number 79. the magazine says california has nearly a third of the schools

the justice minister says the first weddings could take place in june. france is the 14th country to legalize gay marriage. last week, new zealand allowed same-sex marriage to take place. >> at home it is called the worst flood in recorded history in the midwest and today they are bracing for even more rain. right now, flooding along the mississippi is causing massive problems from illinois to iowa and south in missouri. shipping has resumed along the 15-mile stretch near st. louis. the coast guard says barges that sank last week will not interfere with navigation. but in michigan, kayaks outnumber cars on the street. >> hard to imagine and we have not seen rain if some time. >> feast or famine in the forecast. they are getting too much. we don't have enough. it is the way things are going with climate change. >> here is what is going on on live doppler 7 hd. can you see how dry it is. that is one of the reasons we

are seeing such wild temperature swings, the dry ground cannot hole the heat from the sun as well and the moist ground can without giving it back to us. that is a reason why we see tremendous fluctuation and the wind, at half moon bay they are coming from the southwest and that is why you are cooler than everyone else by a good 20 degrees with gusty winds up north and no trees or power power lines down since this morning and the gusts are fastest at fairly at 26 and conquered at 21 and napa at 20. half moon bay is 52. that is the same thing in ocean beach right now, but it is 20 degrees warmer headed to downtown san francisco at 72. that is the same temperature in oakland and san carlos and 75 in san jose, and los gatos and mountain view. today, we are going do have warm temperatures again but just not record-setting. we will have more clouds and cooler conditions tonight, we are in the 50's and 60's talking

about it being a warm morning and it was, tomorrow morning, not is much, so easier to sleep tone. milder, warm and dry for the weekend. walnut creek, the neighbor to the north, concord, set a high yesterday with a reporting station with 30 years of data before it was official but it set a record high at 89. 87 in oakland and none in santa rosa and all the temperatures are six to nine degrees cooler. san francisco is about 12 degrees cooler than year at 74. here is what is happening in the south bay, temperatures are above average with low-to-mid 80's, and san jose at 83 along with cupertino, and peninsula started at 80 at palo alto and 74 in millbrae and along the coast, spotty clouds and sunshine and mid-60's, and the 68 in the sunset was from this morning, the high, as we know, you are at 52. so the highs are already, and 74 in downtown and a couple more degrees before we level off. 68 in sausalito, and upper 70's

to low 80's through most of the north bay valley and warmer in napa at 84, and at the beaches, mid-70's around hayward and upper 70's for the rest of the east bay short and low-to-mid 80's inland where we do not need the air conditioning and congratulations if you did not turn it on year. back home, it is going to be more normal, more breezy, cool we, 63, dropping to a light jacket needed. temperatures are 20 degrees cooler in some areas like the north bay, and low 50's around the bay. the seven-day outlook drops four to six degrees tomorrow, another four to six degrees on tuesday which is the coolest and wake up to cloud cover on thursday morning. then it evaporates and our temperatures are warm ever-so-slightly away from the coast we are above average through the weekend. >> thank you, mike. coming up, the big reveal. are the begin falcons on
